Prosecution in Fayette homicide case intends to present evidence of harassment
Prosecutors in the homicide case involving a Washington County man accused of shooting and killing a man outside of a Fayette County bar and restaurant filed notice they intend to introduce evidence that defendant harassed the victim.
Assistant District Attorney Sean Lementowski filed the notice to present evidence of crimes, wrongs and other acts against Nathan Yasek.
Yasek, 36, of Eighty Four is accused of fatally shooting Timothy C. Durst, 54, of Uniontown in the parking lot of a bar and restaurant in downtown Uniontown on Nov. 24, 2017.
At Yasek’s trial, scheduled for this  week, Lementowski said prosecutors will introduce evidence in the form of statements from two individuals showing specific instances in which Yasek allegedly harassed Durst.
Lementowski said the evidence would help bolster the contention that Yasek had both motive and intent to kill Durst, and was aware of Durst’s identity when he shot and killed him.
Police said Yasek was urinating in the parking lot at his truck when Durst approached him from behind. After the shooting, police said, Yasek went into the bar, where the Fayette County sheriff was, and told him he shot Durst in self-defense. Yasek directed the sheriff to his gun, wallet and gun permit. Yasek faces charges of criminal homicide, aggravated assault and reckless endangerment.
He is free on $100,000 bond.
